Welcome to FotoRevive! These Terms of Use ("Terms") govern your access to and use of the FotoRevive website (the "Site") and the FotoRevive mobile application (the "App"), collectively referred to as the "Service". The Service is owned and operated by Yanmei Chen ("we," "us," or "our").

By accessing the Site or downloading/using the App, you agree to be bound by these Terms. If you do not agree with any part of these terms, you should not access or use the Service.

1. Acceptance of Terms

These terms apply to all visitors, users, and others who access or use the Service. We retain all rights to the Service, including all trademarks, copyrights, database rights, and other intellectual property rights associated with it.

2. License and Restrictions

We grant you a limited, non-transferable, revocable, non-exclusive license to access the Site and/or download, install, and use a copy of the App on your device for personal, non-commercial purposes. You may not:

• Copy or modify the Service, any part of the Service, or our trademarks in any way.
• Attempt to extract the source code of the App or Site.
• Translate the Service into other languages or create derivative versions.
• Use the Service for any illegal or unauthorized purpose.

3. User Content and Conduct

Our App allows you to upload photos and videos ("User Content") for AI processing. By using the App, you agree that:

• Ownership: You represent and warrant that you own the User Content or have the necessary licenses, rights, consents, and permissions to use and authorize us to process your User Content.
• Prohibited Content: You agree NOT to upload any content that is unlawful, pornographic, defamatory, promotes hate speech, violence, or infringes on the intellectual property or privacy rights of others (including creating "deepfakes" of individuals without their consent).
• Liability: You are solely responsible for the User Content you upload. We claim no ownership over your User Content but require the right to process it to provide the Service. We reserve the right to terminate your access if you violate these rules.

4. Changes to Service and Charges

We reserve the right to modify the Service (both App and Site) or charge for its services at any time, for any reason. Any charges will be communicated clearly to you.

5. Data and Security

The Service may store and process personal data you provide to deliver our functionality. You are responsible for securing your device and access to the App. We recommend not jailbreaking or rooting your device. By using the Service, you verify that you have read and agree to our Privacy Policy.

6. Usage Responsibilities

You are responsible for:

• Ensuring an active internet connection for the App's full functionality.
• Any charges from your mobile/internet provider related to data usage.
• Ensuring your device is charged and functioning.

7. Third-Party AI Services & Disclaimers

The Service's core functionality relies on third-party AI models (e.g., Replicate). We are not responsible for and do not endorse, support, or guarantee the quality, reliability, accuracy, or legality of the results generated by these Third-Party Services. AI generation is probabilistic; results may vary or contain artifacts. Your use of these AI features is at your own risk.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

8. Updates, Interruption, and Termination

We may, from time to time, develop and provide updates. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice to you.

9. Subscription Terms (App Only)

For auto-renewable subscriptions purchased via the App:

• Payment: Charged to your iTunes Account at confirmation of purchase.
• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
• Management: You may manage subscriptions and turn off auto-renewal in your Apple ID Account Settings after purchase.
• Apple EULA: We follow the standard Apple Terms of Use (EULA).

10. Compliance and Indemnity

You agree to comply with these Terms and all applicable laws. You will indemnify and hold harmless Yanmei Chen and affiliates against any claims, damages, or legal fees related to your use of the Service, your violation of these Terms, or your violation of any rights of another person.

11. Feedback

We welcome feedback. You grant to us a non-exclusive, worldwide, perpetual, royalty-free license to use any feedback or suggestions you provide for any purpose without compensation to you.

12. Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by FotoRevive. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

13. Changes to Terms of Use

These Terms of Use may be updated periodically. We advise you to review this page for any changes. Changes are effective immediately after they are posted on this page.
